Nature of Products Myoilarts specializes in custom handmade portrait oil paintings. All artworks are original, hand-painted pieces created by professional artists based on customer-provided reference photographs. Each painting is unique and may exhibit natural variations in brushwork, texture, and color that are inherent to handmade oil paintings. Such variations are not defects and do not constitute grounds for return or refund.
Intellectual Property All artworks created by Myoilarts remain the intellectual property of Myoilarts until full payment has been received. Upon receipt of full payment, the physical artwork is transferred to the customer; however, Myoilarts retains all reproduction rights, copyright, and the right to use images of completed works for portfolio, marketing, and promotional purposes, unless otherwise agreed in writing.
Customer-provided reference photographs are used solely for the purpose of creating the commissioned artwork. By submitting photographs to Myoilarts, the customer confirms they hold the necessary rights to use those images for this purpose and indemnifies Myoilarts against any third-party intellectual property claims arising from the use of such photographs.
Custom Order Disclaimer All custom portrait paintings are made-to-order and are considered final sale once production has commenced. Myoilarts is not liable for dissatisfaction arising from subjective aesthetic preferences, provided the artwork has been produced in accordance with the customer's submitted reference materials and approved specifications.
Myoilarts reserves the right to decline any commission that involves content deemed offensive, unlawful, or in violation of third-party rights.
Limitation of Liability To the maximum extent permitted by applicable law, Myoilarts's total liability to any customer shall not exceed the amount paid by that customer for the specific order giving rise to the claim. Myoilarts shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our products or services.
Myoilarts is not responsible for damage to artworks caused by improper handling, storage, or display by the customer after delivery.
Artwork Care Disclaimer Oil paintings require proper care to maintain their condition. Myoilarts is not liable for deterioration resulting from exposure to direct sunlight, extreme humidity, moisture, or improper framing after the artwork has been delivered to the customer.
Governing Law This Legal Notice and all matters relating to your purchase from Myoilarts are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
Amendments Myoilarts reserves the right to update or amend this Legal Notice at any time without prior notice. The current version will always be available on our website.
